GUP Vodokanal of Petersburg, taking advantage of the situation with coronavirus, made purchases of 3 billion rubles without bidding. Contracting organizations file complaints with the OFAS, but so far the controlling body is taking the side of the state-owned enterprise.
Two purchases of 1.58 billion rubles concerned the construction of water and sewer networks for the ITMO Highpark project in the future satellite city of Yuzhny. For both of them, EnergoSet LLC from the Moscow Region was appointed a contractor. The company was a supplier of 360 government contracts worth 10.87 billion rubles. The reconstruction of sewer networks on Kultury avenue from Lunacharsky avenue to Enlightenment avenue was entrusted to St. Petersburg for 873 million rubles LLC “Energy Construction”
. This company also fulfilled orders of MOESK and FGC UES, and in total its assets included 28 state contracts for 18 billion rubles.
Finally, Vodokanal intends to spend 437 million rubles on overhaul of the equipment of the sludge treatment complex at the Northern Aeration Station. The contractor selected Techno-Service LLC from St. Petersburg. He has 35 government contracts worth 257 million rubles. Vodokanal of Petersburg already had contracts with this company for the repair of equipment.
Concluding contracts with sole suppliers to Vodokanal was allowed by law 223-FZ. He instructs the PMUs to be guided by their own procurement regulations, if at the same time budget funds are not spent. This provision at Vodokanal allows purchases without tenders during a pandemic and quarantine measures, as well as “in order to prevent the threat of their occurrence.”

Also, the State Unitary Enterprise noted that the purchase was preceded by a request for proposals from counterparties, as a result of which the company saved 155.8 million rubles.
The complaints that the OFAS will consider were filed by StroyExpert Makhov LLC, owned by Lev Makhov. The company also actively works with state orders, but most of its state contracts related to the technical examination of various buildings and structures. In 2010, Lev Makhov said in an interview that his company carried out a full range of works on the reconstruction and restoration of the monument house on Tambovskaya ul. 16, participated in the construction of a passenger complex at Rybatskoye metro station, and designed a number of bomb shelters, including order of the St. Petersburg Vodokanal.
In his complaints, Lev Makhov indicated that Vodokanal introduced a clause on the pandemic in its procurement provision on April 14, when the coronavirus was already raging in the country. Moreover, the PMU initially planned to conduct similar purchases in the competitive bidding regime, the author of the complaint noted, referring to the procurement plan of Vodokanal for 2020. A representative of StroyExpert Makhov LLC explained to dp.ru that the company intended to participate in these competitions.
